Terms of Service

These Terms of Service ("Terms") govern your access to and use of the mobile game Marble Run (the "Game"), developed by The Sixth Hammer ("we", "us", or "our") and published by Voodoo. Please read these Terms carefully before using the Game.

1. Acceptance of these Terms

By downloading, installing, accessing, or using the Game, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree with these Terms, do not download or use the Game. Your use of the Game is also subject to the terms and policies of the platform from which you obtained it (for example, the Google Play Store).

2. Eligibility

You must be old enough to form a binding contract and to use the Game under the laws of your country, and you must meet the minimum age required by the platform store and our Privacy Policy. The Game is not directed to children under the age of 13 (or the equivalent minimum age in your jurisdiction). If you are a minor, you should only use the Game with the involvement and consent of a parent or legal guardian.

3. License to use the Game

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use the Game on a device you own or control, solely for your own personal, non-commercial entertainment.

4. Restrictions

You agree that you will not, and will not attempt to:

• Copy, modify, adapt, translate, reverse engineer, decompile, or disassemble any part of the Game, except to the extent this restriction is prohibited by applicable law;
• Distribute, sell, rent, lease, sublicense, or otherwise commercially exploit the Game;
• Use cheats, automation software, bots, hacks, mods, or any unauthorized third-party software to modify or interfere with the Game;
• Disrupt, overburden, or interfere with the proper working of the Game or any servers or networks connected to it;
• Remove, obscure, or alter any proprietary notices contained in the Game; or
• Use the Game for any unlawful purpose or in violation of these Terms.

5. Intellectual property

The Game and all of its content, including but not limited to software, graphics, artwork, designs, text, sounds, music, and trademarks, are owned by The Sixth Hammer, Voodoo, or their respective licensors and are protected by intellectual property laws. Except for the limited license granted in these Terms, no right, title, or interest in or to the Game is transferred to you.

6. Advertising and third-party services

The Game is provided free of charge and is supported by advertising. The Game may display advertisements and may use third-party services for monetization, analytics, crash reporting, and performance monitoring, including services required by our publisher, Voodoo. Advertisements may contain links to third-party websites or services that we do not control and for which we are not responsible. Your interactions with third-party services, and any data processed by them, are described in our Privacy Policy and governed by those third parties' own terms and policies.

7. In-app purchases

The Game is offered free of charge. If the Game offers optional in-app purchases at any time, such purchases are processed by the applicable platform store (for example, Google Play) and are subject to that store's terms, including its payment, refund, and cancellation policies.

8. Updates and availability

We may update, modify, suspend, or discontinue the Game (or any feature of it), in whole or in part, at any time and without liability to you. We may also release updates that you may need to install for the Game to continue functioning correctly. The Game may be unavailable from time to time due to maintenance, technical issues, or factors beyond our control.

9. Disclaimer of warranties

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE SIXTH HAMMER, VOODOO, OR THEIR AFFILIATES, OFFICERS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE GAME. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

11. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless The Sixth Hammer and its affiliates from any claims, damages, losses, liabilities, and expenses arising out of your misuse of the Game or your violation of these Terms.

12. Termination

These Terms apply for as long as you use the Game. You may stop using the Game and uninstall it at any time. We may suspend or terminate your access to the Game at any time if you breach these Terms or if we discontinue the Game. Upon termination, the license granted to you ends, and the provisions of these Terms that by their nature should survive (including intellectual property, disclaimers, limitations of liability, and indemnification) will continue to apply.

13. Governing law

These Terms are governed by and construed in accordance with the laws of the Republic of Bulgaria, where The Sixth Hammer is established, without regard to its conflict-of-laws principles, and subject to any mandatory consumer protection laws of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.

14. Changes to these Terms

We may revise these Terms from time to time. When we do, we will update the "Effective date" at the top of this page. Your continued use of the Game after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you should stop using and uninstall the Game.
